No Smoking Means No Smoking – Medford Property Management Rules

WOW we can’t believe it’s July first already! That means two things; we are at the halfway point in the year and…. drum roll.. marijuana is legalized in Oregon as of July 1, 2015. Now depending on where you stand on the legalization of marijuana this can be good or this can be bad.

I wanted to give everyone a quick overview of some of the rules and regulations regarding marijuana. Please note this blog is not to be used as a source for legal advice. I have attached a few great webpages at the bottom for more indepth information.

Below are 10 rules & regulations for the new marijuana laws in Oregon.

  1. You must be 21 or over to legally smoke marijuana
  2. You can only do it in the privacy of your own home
  3. If you are a landlord you don’t have to accept smoking inside your home
  4. Oregonians can grow up to four plants on their property
  5. A person can possess up to eight ounces of usable marijuana in their homes
  6. A person can carry up to one ounce on their person
  7. Marijuana cannot be smoked or used in a public place.
  1. Plants and products cannot be made visible to the public
  2. Landlords can write into their lease a ban on marijuana growing IN the home
  3. Landlords can prohibit alterations to the rental for growing purposes

 

What is the difference between recreational marijuana and medical marijuana?

Medical marijuana is for patients with qualifying medical conditions. Recreational marijuana, whether grown at a residence or obtained from a licensed retail outlet, is for personal use for adults 21 years of age or older. For more information on medical marijuana see www.mmj.oregon.gov.

 

Measure 91 specifically states it does not affect existing landlord/tenant laws or Oregon medical marijuana law. Growing marijuana is still illegal according to the federal government. As a result, landlords can prohibit recreational marijuana from their rentals as easily as they can prohibit tobacco. As a homeowner you can ask your property manager to have this clause added to their tenant contract for our home.  Since it is federally prohibited to grow marijuana, you can also prevent Tenants from growing on your property.  Depending on how you view it, and the type of property you have, you may want to allow it. That is up to you as the Owner, and we will consult as you deem necessary.
